PERSONAL HEALTH INFORMATION

 PRIVACY POLICY


HearCANADA is responsible for and committed to protecting personal health information in its custody or under its control. HearCANADA does not collect, use or disclose your personal health information except as described in this Policy.

Collection of Personal Health Information

HearCANADA collects personal health information about you directly from you or from the person acting on your behalf to provide you with hearing and related health care services. The personal health information that we collect may include, for example, your name, date of birth, contact information,health history, health care providers, diagnosis, treatment plan, provincial health card number and insurance or coverage information.

Occasionally, we collect personal health information about you from other sources, such as a family member or other health care provider if we have obtained your consent to do so or if the law permits us to do so.


Use and Disclosure of Personal Health Information

HearCANADA uses and discloses personal health information for the following purposes:

Treatment: HearCANADA uses personal health information to coordinate and provide you with hearing services and related health care services. We may share personal health information about you in order to coordinate specific services, such as prescriptions, lab work and x-rays. We may disclose personal health information to your family physician, consulting physician(s), nurses, technicians,audiology students, and other health care providers who have a legitimate need for such information in order to provide you with health care services.

Payment: HearCANADA may release your personal health information for the purposes of determining coverage, billing, claims management, medical data processing, and reimbursement. The information may be released to a third party payer (e.g. Assistive Devices Program (ADP), Department of Veterans Affairs (DVA), Workplace Safety Insurance Board (WSIB), provincial health insurance plan, private insurance or other entity (or their authorized representatives) involved in the payment of your bill and may include copies or excerpts of your medical record which are necessary for payment of your account. For example, a bill sent to a third party payer may include information that identifies you, your diagnosis, and the procedures and supplies used.

Our Operations: HearCANADA may use and disclose your personal health information to run our business, including for quality assurance, utilization review, medical review, internal auditing, due diligence, accreditation, certification, licensing or credentialing activities of HearCANADA.

HearCANADA may engage outside companies to carry out certain aspects of our business on our behalf. HearCANADA requires these companies to protect the privacy and confidentiality of your personal health information.

Other Reasons: HearCANADA may use and disclose your personal health information for other reasons, including:

• Family/Friends: HearCANADA may disclose your personal health information to family members or others who provide you with support, with your consent or as permitted or required by law without consent.

• Research, education and statistics: HearCANADA may use or disclose your personal health information to conduct research, to educate its agents, and to compile statistical information. While most clinical research studies require specific client consent, there are some instances where personal health information may be disclosed for research purposes without consent. Under these circumstances, HearCANADA may disclose your personal health information for approved clinical research studies.

• Regulatory agencies: HearCANADA may disclose your personal health information to federal or provincial regulatory authorities for activities authorized by law, including, but not limited to, licensure, certification, audits, investigations and inspections.

• Legal purposes: HearCANADA may disclose your health information for law enforcement purposes as required by law (e.g. in response to a court order).

• Mandatory reports or risk of harm: HearCANADA may disclose your personal health information to comply with a mandatory reporting obligation (e.g. communicable or reportable disease, suspected child abuse or neglect) or where we believe disclosure is necessary to prevent a serious risk of harm to you or to someone else.

• As otherwise required by law: HearCANADA may disclose your personal health information in any situation in which such disclosure is permitted or required by law.

• Electronic communications: With your consent, we may send you electronic communications to tell you about or recommend possible treatment options or alternatives that may be of interest to you, such as new products or services or for administrative reasons such as scheduling and appointment reminders.


Safeguards

HearCANADA protects your personal health information through our privacy practices, which include the adoption of administrative, technological and physical safeguards to protect against theft, loss and unauthorized access, copying, modification, use, disclosure or disposal of personal health information.


Your Rights Related to Your Personal Health Information:

HearCANADA respects your rights concerning your personal health information, including:

• Right to access your personal health information: You generally have the right to view and receive a copy of your personal health information, except as restricted by law.

• Right to request correction: If you believe your record of personal health information is incorrect or incomplete, you have the right to request the correction of your personal health information.

• Right to request restrictions: Subject to applicable privacy laws, you have the right to request that we restrict or limit the collection, use or disclosure of your personal health information for health care purposes.

• Right to withhold or withdraw consent: You have the right to withhold or withdraw your consent to the collection, use or disclosure of your personal health information at any time by advising us in writing. This withdrawal of consent does not have retroactive effect (we cannot take back any uses or disclosures that we have already made with your authorization).

If you wish to exercise any of these rights, you can make a request in writing to our Privacy Information Officer or you may speak with a member of your HearCANADA health care team.


Changes to this Privacy Policy:

HearCANADA reserves the right to change the terms of this Policy at any time. Any new notice provisions will be effective for any personal health information that we have about you and to the personal health information that we receive in the future.

This Policy is effective as of October 17, 2023.
